These Terms of Service govern your use of the Emberandpines website and any purchase you make from us. Emberandpines is operated by Ember & Pines. By using this site or placing an order, you agree to these terms. If you do not agree, please do not use the site.

1. Eligibility

You must be at least 18 years old, or the age of majority in your state of residence, to use this site and place orders. Our products are sold only to customers in the United States.

2. Products, pricing and images

All products are subject to availability. Product descriptions, prices and images may change at any time without notice. Images are for illustration, and colors may look slightly different depending on your screen. We work hard to keep information accurate, but if a price or listing error occurs, we reserve the right to correct it; any affected order may be canceled and fully refunded.

3. Orders and acceptance

Placing an order does not mean we have accepted it. We may refuse or cancel an order for reasons including limited or unavailable stock, a payment issue, suspected fraud, a pricing or listing error, or shipping restrictions. If we cancel an order after payment, we refund you to your original payment method.

4. Cancellations

You may cancel an order only before it enters processing or shipment. To request a cancellation, email us with your order number as soon as possible. There is no fee to cancel an eligible order. Shipping, returns and payments are further described in our Shipping Policy, Returns & Refunds Policy and Payment Information.

5. Intellectual property

All content on this site, including artwork, designs, text, graphics, logos and images, is owned by or licensed to Ember & Pines and is protected by intellectual property laws. You may not copy, reproduce, distribute or use any content without our prior written permission.

6. Prohibited use

When using this site, you agree not to:

• Use the site for any unlawful purpose
• Attempt to gain unauthorized access to the site, its systems or its data
• Upload or spread viruses, malware or other harmful code
• Interfere with or disrupt the operation of the site
• Scrape, harvest or collect content or data from the site by automated means
• Infringe the intellectual property or other rights of Ember & Pines or anyone else

7. Disclaimers and limitation of liability

This site and its content are provided "as is" and "as available," to the fullest extent permitted by law. To the extent permitted by law, the total liability of Ember & Pines for any claim related to an order is limited to the amount you paid for that order.

8. Indemnification

You agree to indemnify and hold harmless Ember & Pines from any claims, losses or expenses arising from your misuse of the site or your violation of these terms.

9. Governing law and disputes

These terms are governed by the laws of the United States and of the State of Wisconsin, where Ember & Pines operates. If a dispute arises, please contact us first so we can try to resolve it informally. If we cannot reach a resolution, the dispute will be resolved by binding arbitration where permitted by law. Either party may still bring an eligible claim in small claims court.

10. Changes to these terms

We may update these Terms of Service from time to time. Changes take effect as soon as they are posted on this page, and the date above shows when they were last revised. Continuing to use the site after changes are posted means you accept the updated terms.
